Terms & Conditions

The information on this Website is intended for and relevant to UK residents only. Access to and use of this site is subject to the following terms and conditions, which you are deemed to have accepted in full by accessing this site.

The following Terms & Conditions are in conjunction with the Terms of Contract set by the relevant finance company. Please read these terms carefully and retain a copy along with your order for future reference.

These terms and conditions apply between you and John Clark Leasing for the acquisition via various funding options of UK vehicles listed on our website, and is supplied by recommended dealers/manufacturers.

Orders

Your order of a vehicle from our website is an offer by you. All orders are subject to acceptance by us, availability, price changes and the payment of a deposit in accordance with your accepted order. If the vehicle you have ordered is not available, we will contact you by email or telephone to provide possible alternatives. If the vehicle is available and we accept your offer then we will contact you to request payment of the deposit in accordance with your accepted order.

Prices

  1. The prices quoted exclude VAT and are for business users only. Should the VAT rate change between the point of taking the order to the supply of the vehicle, payments will be adjusted accordingly. Prices also include delivery by the dealer to your chosen UK mainland destination, number plate, Road Fund Licence for the term (if applicable) and Vehicle Registration Charge.
  2. We reserve the right to change the price either before or after we accept any order. We shall notify you of such a change and you have the right to cancel your order if the change is not acceptable.
  3. Prices quoted may be subject to change depending on vehicle colour. This is due to different residual values set by the finance company or stock availability.
  4. Prices on the web site are for information purposes only and do not constitute an offer by us capable of an acceptance by you.
  5. With some orders a deposit may be required, you will be advised of the amount at the point of order. Subsequent cancellation may result in the loss of your deposit (subject to the discretion of John Clark Leasing)
  6. Upon agreement by both parties and the relevant order form accepted by you, a processing fee of £200 plus VAT will be taken by credit/debit card, bank transfer, or cheque. After finance acceptance has been confirmed, a deposit will be taken by credit/debit card, bank transfer, or cheque. Credit card payments incur a 2.5% surcharge.

Specification and Images

The vehicle specifications displayed on the website are supplied by the vehicle manufacturers to CAP and formatted for our use. Whilst every effort is made to verify and ensure the accuracy of the data, the information should only be used as a guide and no purchasing decision should be made without verification of the latest data from either the manufacturer or franchised dealer. As a result we will not be liable for any loss or damage arising, in contact tort or otherwise, directly or indirectly from the use of or reliance upon any information contained on the Website, nor products or services provided by third parties (individuals or corporates) featured on the site. All images on the website are for illustration purposes only.

Delivery/Registration

  1. Upon receipt of correct finance documentation and any balance of monies we will arrange delivery of the vehicle to your chosen destination. Please note that the monthly rental price includes road driven delivery within the UK mainland. Certain delivery locations may incur an additional delivery charge, therefore we reserve the right to pass this charge onto you. We will advise you of any further charges prior to you accepting our order. If requested vehicle transported delivery can be arranged at an extra charge, please ask your Leasing Consultant for further details.
  2. Information on "lead times" are estimates only and do not constitute an obligation to supply. John Clark Leasing has no control or influence over manufacturer lead times and will not be held responsible for any losses or inconvenience caused because of a manufacturer delay.
  3. Please note that the statutory cooling off period set by the finance company applies to all vehicles 
  4. Local registrations of vehicles are not possible.
  5. Delivery dates are subject to change by the manufacturer.
  6. Proof of insurance is required before delivery can take place. Please note that the hirer obtaining finance must be the main policy holder on the insurance certificate.

 Excess Mileage

  1. The excess mileage charge on your order is valid up to 100% of the annual mileage allowance. Any mileage over the 100% allowance may be subject to a higher pence per mile charge. If applicable this will be stated on your lease contract.  

Free Offers / Special Offers

  1. The ’Free Offer’ or ’Special Offer’ banners refer to a promotion that is offered at no extra cost to the customer when they full fill an order with John Clark Van Leasing.
  2. The promotional gifts are offered on selected vehicles only and are subject to purchase. The promotional gift will be dispatched after customer has taken delivery of the car.
  3. In the event of a promotional gift becoming unavailable, a substitute of similar style and equal or greater value will be supplied.
  4. The Promoter accepts no responsibility for claims that are lost, damaged or delayed in the post.
  5. John Clark Leasing reserves the right to withdraw or amend any ’Free Offers’ or ’Special Offers’ at any time.

Statutory Rights

  1. Nothing in these conditions shall affect your statutory rights.
  2. John Clark Leasing is committed to customer service. Should you have any complaint about the our service, we will endeavour to resolve them in a fair and effective manner.
  3. For a copy of our customer complaints procedure or if you have a complaint about our service you should email us. We are committed to acknowledging your complaint within 3 working days of receipt and undertaking all reasonable efforts to resolving it promptly under the circumstances. We will provide you with a time scale for resolving the dispute and keep you regularly updated with its progress.
